(Note: The following press release was sent to me, an Orange County DUI Lawyer, from law enforcement, and I post it here as information for drivers in Orange County).

Ahhh, Friday night…end of the work week and time to unwind!

But be advised: If your plans to unwind Friday night, Aug. 28, include a stop at a favorite local watering hole, the Fullerton Police Department may have a little surprise for you.

The department will host a special DUI checkpoint on the 28th in an effort to help keep Fullerton’s streets safer for everyone.

The checkpoint will be held from 9 p.m.-3 a.m., and the location is not being announced, but will be on a major thoroughfare.

Motorists passing through the checkpoint will receive safe driving literature from Mothers Against Drunk Drivers (MADD), and Community Services Programs Inc.

The checkpoint is funded under the “Avoid the 28” grant from the Office of Traffic Safety and administered by the Anaheim Police Department. The “28” are the 28 Orange County law enforcement agencies, including Fullerton.

Charges stem from Southern California drunk driving incident.

Robert Avary DUIRoger Avary, screenwriter of ‘Pulp Fiction’, has entered a guilty plea to vehicular manslaughter and driving under the influence in California. Avary had been accused of causing the death of a passenger when he hit a telephone pole with his Mercedes in Ojai, California. His wife was injured in the January 13, 2008 accident. He pleaded not guilty to the charges last December though has since apologized for the drunk driving incident.

Avary wrote ‘Pulp Fiction‘ with Quentin Taratino and won an Academy Award for the screenwriting in 1995.

Reality show husband arrested for drunk driving in Orange County last Saturday.

One of the husbands featured on the cable reality show ‘The Real Housewives of Orange Count’ was arrested last Saturday for allegedly driving under the influence in CA.

Matt Keough reportedly rolled through a stop sign in Coto de Caza and then refused to stop for police officers until he arrived at his home. The 54-year submitted to a breath test and registered a blood-alcohol content three times the legal limit. He was booked for California DUI by the Orange County Sheriff’s Department and later released after posting $10,000 bail.

Keough was convicted of felony DUI in California in 2005 after rear-ending another car, rolling into a pedestrian and then wandering away from the accident scene. The pedestrian was hospitalized with a knee injury. Then in January 2008 he was sentenced to 180 days in an Orange County jail for drinking in violation of the terms of his probation.

A former major league baseball pitcher, Keough was drafted by the Oakland A’s right out of high school. He also played for the New York Yankees and the Chicago Cubs. On the reality television show Keough is the husband of cast member Jeana Tomasin.

Fullerton DUI Checkpoint August 28, 2009

The Costa Mesa Police Department announced a DUI Checkpoint for September 1, 2009, as part of the after-report from the August 26, 2009 DUI Checkpoint.

The Costa Mesa Police Department conducted a sobriety checkpoint on Wednesday August 26, 2009, at Wilson Street and Pomona Avenue. Funding for this program is provided by a grant from the California Office of Traffic Safety through the Business, Transportation, and Housing Agency and is part of a National enforcement campaign.
During the hours of operation, 570 vehicles drove through the checkpoint, 237 vehicles were stopped, and17 drivers were screened for driving under the influence. One driver was arrested for DUI and one driver was arrested for possession of marijuana for sales. In addition, 5 drivers were cited for no licenses and 1 for driving on a suspended license. A total of 12 citations were issued for miscellaneous vehicle code violations and 7 vehicles were impounded.
The Costa Mesa Police Department will be teaming up with Mothers Against Drunk Driving (M.A.D.D.) for another checkpoint on September 1, 2009 and as with all our checkpoints, there will be an increased number of officers patrolling adjacent streets in an effort to stop impaired drivers from avoiding the checkpoint.

The Moreno Valley Police Department will be conducting a DUI/Drivers License checkpoint on Friday, August 28 from 6:00pm – 2:00am within the City of Moreno Valley. In an effort to reduce the number of persons killed and injured in alcohol involved crashes, DUI checkpoints are conducted to identify offenders and get them off the street, as well as educate the public on the dangers of impaired driving.

All too often, members of our community are senselessly injured or killed on local roadways by impaired drivers. This DUI/Drivers License checkpoint is an effort to reduce those tragedies, as well as insuring drivers have a valid driver’s license. A major component of these checkpoints is to increase awareness of the dangers of impaired driving and to encourage sober designated drivers.

A DUI checkpoint is a proven effective method for achieving this goal. By publicizing these enforcement and education efforts, the Moreno Valley Police Department believes motorists can be deterred from drinking and driving.

Traffic volume and weather permitting, all vehicles may be checked and drivers who are under the influence of alcohol and/or drugs will be arrested. Our objective is to send a clear message to those who are considering driving a motor vehicle after consuming alcohol and/or drugs – Drunk Driving, Over the Limit, Under Arrest. The public is encouraged to help keep roadways safe by calling 911 if they see a suspected impaired driver.

Encinitas Sheriff’S Station Targeting Impaired Drivers In Special Summer Enforcement

Mobilization Theme Is “Drunk Driving, Over the Limit, Under Arrest”

William D. Gore, Sheriff, County of San Diego, announced the City of Del Mar will be deploying deputies from the Encinitas Sheriff’s Station on saturation patrols and DUI/drivers license checkpoints. A checkpoint is scheduled for August 29, 2009 between 8:00 p.m. and 2:00 a.m. The check point will be conducted near the 1100 block of Camino Del Mar.

The San Diego Sheriff’s Department is placing 30-day holds on vehicles driven by drivers who are unlicensed or have a suspended license. This can be a costly experience with storage costs up to $1,500. Drivers with a suspended license or who are arrested for driving under the influence can incur legal costs amounting to several thousand dollars, as well as paying for their stored vehicle. The California Office of Traffic Safety, along with local law enforcement agencies, encourage citizens to “Report Drunk Drivers, call 911” if they see a drunk driver on the road. Provide law enforcement with the exact location, vehicle make and model and license plate. One call could save a life. Motorists who elect to drink alcoholic beverages are encouraged to designate a sober driver or to call a taxi.

This year, the State of California Office of Traffic Safety and the San Diego Sheriff’s Department remind drivers: Drunk Driving, Over the Limit, Under Arrest.

Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.

(The following press release about a DUI checkpoint in Loma Linda was sent to me from law enforcement and is posted here for your education).

“DRUNK DRIVING. OVER THE LIMIT. UNDER ARREST.”

On Friday, September 4th, 2009, between 6:00 P.M. and 2:00 A.M., The Loma Linda Police Department will conduct a Driving Under the Influence Checkpoint on Redlands Blvd. in the City of Loma Linda. The goal is to identify/arrest drunk drivers and reduce the number of accidents, injuries, and deaths attributed to impaired drivers.

Despite the tireless efforts of thousands of advocates and law enforcement officers alike, drunk driving continues to be one of America’s deadliest crimes. The checkpoint will serve as a reminder to Loma Linda residents to use designated drivers and not drink and drive.

The “Drunk Driving. Over the Limit. Under Arrest.” Program is funded through a grant awarded to the City of Loma Linda from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

Note: I received the following DUI Checkpoint press release from law enforcement. I present it here for your information:

On Friday evenings 08/21/2009 and 08-28-2009, the San Marcos Sheriff’s Traffic Division, with cooperation from the North County Law Enforcement Traffic Safety Council, will conduct Driving Under the Influence checkpoints at undisclosed locations in the City of San Marcos.

These details are part of the on-going effort by the California Office of Traffic Safety, the City of San Marcos and the Sheriff’s Traffic Division to reduce the number of drunken driving traffic collisions and related incidents during the busy summer months. The checkpoint will be staffed by San Marcos deputies, senior volunteers, and representatives of the North County Law Enforcement Traffic Safety Council.

MISSION: The purpose of the operation is to raise awareness, identify and arrest drunk drivers, and allow for a safer driving environment within the City of San Marcos. There will also be enforcement of other California Vehicle Codes relating to seat belt violations along with any other alcohol related or law violations.

Note: The following DUI checkpoint in San Juan Capistrano press release was sent to me from the OC Sheriff’s Department. Ironically, I went through the DUI checkpoint and was sent on for secondary inspection. The police looked at me, shone a flashlight in my car, gave me field sobriety tests, and let me go. (And everyone was professional.)

I question the usefulness of the DUI checkpoint in a rural/farm area off Camino Capistrano near Del Obispo and Avian Road. At 11:45 p.m., the roads seemed to be empty, and the DUI checkpoint in a dark area seemed like an ill advised idea.

Sheriff’s Department To Step Up Dui Enforcement In San Juan Capistrano Thanks To Federal Grant

Safer streets are coming to San Juan Capistrano. Increased enforcement measures are in place for the rest of the year thanks to a $28,764 grant awarded by the Office of Traffic Safety to San Juan Capistrano Police Services and the Orange County Sheriff’s Department. At the August 22, 2009 checkpoint, Deputies will be checking for valid driver’s licenses and impaired drivers.

“DUI checkpoints are an effective tool to keep drunks off the road and to alert the community of our commitment to having safe roadways,” said Lt. Dan Dwyer, Chief of Police Services for the City of San Juan Capistrano. “We want to send a clear message to those who are considering driving a motor vehicle after consuming alcohol and / or drugs – Drunk Driving, Over the Limit Under Arrest. To report a drunk driver, call 911.”

Last year nearly 1600 people were killed and over 31,000 people were injured in California in drug and alcohol related crashes. This grant will focus on reducing those numbers, through both enforcement and education.

The measures taken will specifically target DUI offenders and drivers with suspended or revoked licenses. These checkpoints when utilized have been shown to significantly reduce DUI fatalities. In addition, DUI checkpoints increase public awareness to prevent impaired driving in the first place, and to encourage designating a sober driver.

“When more people drive sober and safely, lives are saved. It’s just that simple,” said Christopher J. Murphy, Director of the Office of Traffic Safety. “This grant will help make San Juan Capistrano just that much safer of a place to live and work.”
