Newport Beach DUI checkpoint results in unusually high 2% arrest rate

Monday, September 28th, 2009

A DUI checkpoint on Dover Drive and 16th Street in Newport Beach netted six arrests on suspicion of driving under the influence, police said Friday.

The Thursday night DUI checkpoint stopped 308 drivers, with police administering field sobriety exams to 11. Of those, six were arrested on suspicion of DUI. Police also issued 11 tickets and impounded seven vehicles, said Sgt. Evan Sailor.

The checkpoint was funded by the state Office of Traffic Safety. I’ve pointed out before how DUI checkpoints don’t really work, how they are political, and how they don’t make the roads safer (but they DO cost thousands and tie up traffic), but for funding reasons, they remain more popular.

The Costa Mesa Police Department conducted a sobriety checkpoint on Tuesday, September 22, 2009, at Wilson Street and Pomona Avenue. Funding for this program is provided by a grant from the California Office of Traffic Safety through the Business, Transportation, and Housing Agency and is part of a National enforcement campaign.

During the hours of operation, 596 vehicles drove through the checkpoint, 267 were stopped, and 14 drivers were screened for driving under the influence.

There was only one DUI arrest!

In addition, 6 drivers were cited for either no license or driving on a suspended license. A total of 13 citations were issued for miscellaneous vehicle code violations and 4 vehicles were impounded.

The Costa Mesa Police Department will be teaming up with Mothers Against Drunk Driving (M.A.D.D.) for another checkpoint on September 29th in the area of Santa Ana and 18th Street. There will also be an increased number of officers patrolling adjacent streets in an effort to stop impaired drivers from avoiding the checkpoint.

The Daily Pilot has news of a DUI Checkpoint in Newport Beach on Thursday, September 24th, 2009.

Newport Beach police will hold a DUI checkpoint Thursday night.

The checkpoint will run from 9 p.m. Thursday to 3 a.m. Friday, on northbound Dover Drive at 16th Street. Police will stop a predetermined number of vehicles and hand out brochures educating drivers on the dangers of drinking and driving.

The location was chosen because of its proximity to bars and restaurants.

The California Office of Traffic Safety provided funding for the checkpoint.

The Daily Pilot also had a story about continued funding for DUI checkpoints (even though they don’t work), as follows:

Newport Beach police will receive nearly $200,000 in state money for its DUI enforcement program after the Newport Beach City Council approved receiving the money last night.

The police department will have $192,000 budgeted for DUI checkpoints, extra patrols focused on DUI enforcement, and other alcohol awareness methods, from Oct. 1, 2009 to Sept. 30, 2010. The money comes from the California Office of Traffic Safety. The city pays for the overtime costs associated with enforcement up front and is reimbursed by the state, according to the City Council staff report.

The following press release was sent to us, due to our relationship with law enforcement as the best DUI lawyers in Orange County. We present it to you for your information and knowledge in planning ahead.

Encinitas Sheriff’s Station Targeting Impaired Drivers In Special Summer Enforcement

Mobilization Theme Is “Drunk Driving, Over the Limit, Under Arrest”

The City of Solana Beach will be deploying deputies from the Encinitas Sheriff’s Station on saturation patrols and DUI/drivers license checkpoints. A checkpoint is scheduled for September 11th, 2009 between 7:00 p.m. and 2:00 a.m. The check point will be conducted near the intersection of Solana Vista and North Highway 101.

The Sheriff’s Department is placing 30-day holds on vehicles driven by drivers who are unlicensed or have a suspended license. This can be a costly experience with storage costs up to $1,500. Drivers with a suspended license or who are arrested for driving under the influence can incur legal costs amounting to several thousand dollars as well as paying for their stored vehicle.

The California Office of Traffic Safety, along with local law enforcement agencies, encourage citizens to “Report Drunk Drivers, call 911” if they see a drunk driver on the road. Provide law enforcement with the exact location, vehicle make and model and license plate. One call could save a life.

Traffic Sergeant Randy Webb encourages motorists who elect to drink alcoholic beverages during this period, to designate a sober driver or to call a taxi.

This year, the State of California Office of Traffic Safety and the San Diego Sheriff’s Department remind drivers: Drunk Driving, Over the Limit, Under Arrest.

Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.

The Escondido Police Department will be conducting a Sobriety / Drivers License Checkpoint in the City of Escondido on Friday night, September 11, 2009 from 6:00 PM until 1:00 AM.

The emphasis of the checkpoint will be to detect drunk drivers and those with suspended, revoked, or no driver license and to continue our education / awareness campaign on the dangers of driving impaired.

This checkpoint is an effort to continue the Escondido Police Department’s commitment to traffic safety by reducing the number of people killed and injured in alcohol-involved collisions.

The checkpoint is being conducted in conjunction with the North County Law Enforcement Traffic Safety Council, the San Diego County DUI Probation Team, and Mothers against Drunk Drivers.

Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.

Traffic Sgt. R. Lawhead explains that the San Bernardino Police Department conducted a DUI/Drivers License checkpoint on Friday, September 4, 2009, from 6:00 PM to 2:00 AM, in the 300 block of W. Baseline Street, in San Bernardino. During the checkpoint 657 vehicles were screened, 26 cites were issued, 20 vehicles were impounded, and 9 arrests were made (6 of those arrests were for DUI).

This program was a part of our ongoing effort to reduce the number of people killed and injured in alcohol involved crashes. DUI checkpoints and saturation patrols are conducted to identify offenders and get them off the street, as well as educate the public on the dangers of impaired driving.

All too often, members of our community are senselessly injured or killed on local roadways by impaired drivers. This DUI/Drivers License checkpoint is an effort to reduce those tragedies, as well as insuring drivers have a valid driver’s license. A major component of these checkpoints is to increase awareness of the dangers of impaired driving and to encourage sober designated drivers.

A DUI checkpoint is a proven effective method for achieving this goal. By publicizing these enforcement and education efforts, the San Bernardino Police Department believes motorists can be deterred from drinking and driving.

Our objective is to send a clear message to those who are considering driving a motor vehicle after consuming alcohol and/or drugs – Drunk Driving, Over the Limit, Under Arrest. The public is encouraged to help keep roadways safe by calling 911 if they see a suspected impaired driver.

Funding for this operation is provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.

IRVINE, CA (September 6, 2009): The Irvine Police Department conducted a sobriety/driver’s license checkpoint during the evening hours on Saturday September 5, 2009. The checkpoint was located at Jamboree and Birch in the City of Irvine. As part of the Drunk Driving: Over the Limit, Under Arrest national DUI crackdown campaign, the purpose of the checkpoint was to deter impaired driving and hold accountable those driving under the influence.

Mothers Against Drunk Driving (MADD) estimates that communities which consistently use sobriety checkpoints experience as much as eight times the reduction in DUI incidents as communities that use roving patrols alone. Checkpoints have been highly effective in educating the public to the hazards of impaired driving. According to MADD, in one survey, 79% of the public approved of sobriety checkpoints.

The California Office of Traffic Safety and the National Highway Transportation Administration have given support for this project.

This checkpoint was staffed by sworn officers and professional staff from the Irvine Police Department, and by community volunteers.

No significant traffic delays were encountered as a result of the checkpoint.

California Highway Patrol

(Note: The following article is from the OC Register, and was sent as part of a press release/news alert to our firm, which specializes in Orange County DUI defense).

The California Highway Patrol arrested 73 people in Orange County on suspicion of drunken driving over the Labor Day holiday weekend, compared to 67 last year.
No one was killed in traffic collisions on Orange County freeways, CHP Officer Jennifer Hink said today.
Several other policing agencies throughout the county also made DUI arrests and cracked down on unsafe driving practices, by holding checkpoints and showing an increased presence over the holiday weekend.
Sheriff’s deputies arrested 35 DUI suspects in checkpoints in Dana Point and Mission Viejo, and through saturated patrol efforts, Sgt. Jerry Brittain said.
Three DUI suspects were arrested in a checkpoint Saturday night in Irvine.
Newport Beach police arrested 10 people suspected of drunken driving, Newport Beach police Lt. Craig Fox said. La Habra police also held DUI enforcement efforts over the weekend. Results were not immediately.
Statewide, 10 people were killed on highways between 6 p.m. Friday and 6 a.m. Monday, the CHP reported. That compares with 23 fatalities during the same period last year, the CHP said. At least half those killed this year were not wearing seat-belts, the CHP said.
The final statewide number for DUI arrests will likely be available later today, CHP spokeswoman Jaime Coffee said.
During these periods, which typically coincide with major holidays, the highway patrol and often other law enforcement increase patrols and stage sobriety checkpoints.
