Police agencies all over Orange County are inviting the media to come along for their DUI checkpoints, which, as someone among the few Orange County DUI Lawyers on the front lines of DUI defense in this county, I have repeatedly reminded people don’t work.
However, I was surprised to see an Orange County Register article mentioning in their photo caption that “DUI checkpoints in Orange County rarely result in many arrests, instead being used as deterrents.”
Funny that they would say that DUI checkpoints are deterrents, since most of the DUI checkpoint locations are not announced, a potential violation of the State of California Supreme Court’s Ingersoll case. If they were not trying to catch people, but merely deter them, shouldn’t they be getting the word out early, vocally, and often, to “deter”, instead of arrest?
The article is below, and I am assuming that it’s based upon the Costa Mesa Police Department after report, which was first published at the Costa Mesa PD website, here.
“COSTA MESA – Motorists on Tuesday night for the most part didn’t let the holiday season ruin their good judgment, as a DUI checkpoint netted just one suspected drunk driver out of nearly 300 cars.
Costa Mesa police from 6 p.m. to midnight staged the sobriety-screening operation on Santa Ana Avenue at 18th Street. During that time, 296 vehicles drove through, 142 were stopped for further screening and 11 motorists were screened for drunken driving, but in the end, there was one DUI arrest. …”

Anaheim Police announced a DUI Saturation Patrol for New Year’s Eve. Starting at 7pm on December 31, 2009, Anaheim will have a Saturation Patrol searching for drunk drivers, until 3:00 a.m. on January 1.

Another one of the Orange County DUI Checkpoint Locations for this holiday season has been revealed, this time in Costa Mesa, and on a Tuesday (not on New Year’s Eve):
The Costa Mesa Police Department will be conducting a sobriety / driver license checkpoint on Tuesday, December 29, 2009, from 6:00 p.m. to 12:00 a.m. The checkpoint will be located northbound Santa Ana Avenue, at 18th Street.
This is Costa Mesa Police Department’s second checkpoint associated with California’s 18 Day Holiday DUI Crackdown Campaign. By the end of the campaign, law enforcement agencies will have deployed 300 DUI/Drivers License Checkpoints statewide. Funding for the special enforcement campaign, which concludes January 3, 2010, comes from a grant from the California Office of Traffic Safety (OTS) through the National Highway Traffic Safety Administration, with volunteer assistance provided by MADD (Mothers Against Drunk Driving).
Orange County DUI arrests were headed down again this year, until the State approved this all out 300 checkpoint holiday sweep, to bring stats up, for law enforcement funding. Looks like this might be the only up year in a 10 year decline in all crimes, especially DUI.

Another one of the Orange County DUI Checkpoint Locations for this holiday season has been revealed, this time in Aliso Viejo, on New Year’s Eve:
The Orange County Sheriff’s Department will be conducting a sobriety / driver license checkpoint on December 31, 2009, from 7:00 p.m. on December 31st to 3:00 a.m. on January 2nd, 2010 in Aliso Viejo. (This may be a misprint on the part of the OC Sheriff’s Department, as it’s unusual for a DUI checkpoint to operate continually for 32 hours. The checkpoint location was not announced.
Orange County DUI arrests were headed down this year, until the State approved an all out 300 checkpoint holiday sweep, to bring stats up, for law enforcement funding. Looks like this might be the only up year in a 10 year decline in all crimes, especially DUI.

Another one of the Orange County DUI Checkpoint Locations for this holiday season has been revealed, this time in Seal Beach, and not on New Year’s Eve:
Beginning this Friday (01/01/2010) at 8:00pm, Seal Beach Police Department will be conducting a sobriety and drivers license checkpoint on Friday, January 1, 2010, in the south end of the city.
Orange County DUI arrests were headed down this year, until the State approved an all out 300 checkpoint holiday sweep, to bring stats up, for law enforcement funding. Looks like this might be the only up year in a 10 year decline in all crimes, especially DUI.

Our Orange County DUI Lawyers found a press release by the Irvine Police Department regarding their a DUI/sobriety checkpoint during the evening hours on Saturday December 19, 2009. The checkpoint was located at Irvine Center Drive and Hubble in the City of Irvine. As part of the California Holiday DUI Crackdown Campaign, the purpose of the checkpoint was to deter impaired driving and hold accountable those driving under the influence.
Mothers Against Drunk Driving (MADD) helped sponsor and provide support to these checkpoints. According to MADD, in one survey, 79% of the public approved of sobriety checkpoints.
Funding for the special enforcement campaign, December 16, 2009 through January 3, 2010 came from a grant from the California Office of Traffic Safety (OTS) through the National Highway Traffic Safety Administration.
This checkpoint was staffed by sworn officers and professional staff from the Irvine Police Department, and by MADD volunteers.
Look at these numbers:

347 vehicles and drivers (not to mention other passengers) inconvenienced, traffic delayed, for zero arrests? For 14 traffic tickets to be issued? As I’ve said so many times, DUI checkpoints are a waste of time, and aren’t even as effective as the more useful saturation patrols. But still, based upon MADD pressure and federal money, they persist.
I often get the argument, “but Robert, if even one drunk driver is taken off the road…”, an argument that has its own logical fallacy, but in this case, as with many others, what if not even one drunk driver is taken off the road?

154 people were arrested on suspicion of driving under the influence in Orange County during a weeklong campaign in effect through Christmas Day, according to the multiagency DUI task force known as “Avoid the 28″.
From Dec. 18 through Dec. 25, avoid the 28 reported that 154 arrests were made in O.C. cities. There were no fatalities.
Sgt. J. Brittain with Orange County Sheriff’s Department Traffic Bureau said the number will be higher because not all agencies have reported their statistics.
Last year, law enforcement agencies reported 309 arrests from Dec. 12 through Dec. 25, with three fatalities.
The campaign, known as “Avoid” – involving the California Highway Patrol, the Orange County Sheriff’s Department and police departments – lasts through Jan. 3.
The California Highway Patrol made 53 DUI arrests on O.C. freeways during its maximum-enforcement period, which started at 6 p.m. Christmas Eve and went through midnight Sunday, said CHP officer Denise Quesada. No fatalities were reported.
Throughout the state, 16 people were killed on highways over the Christmas holiday weekend – the same number of fatalities for the same period last year.
The number of drunken-driving arrests made by the CHP is up, however – to 970 from 824 in 2008. The figures cover the time period from 6 p.m. Christmas Eve until 6 a.m. Sunday.
California’s Office of Traffic Safety has declared 2010 the “Year of the Checkpoint” and has planned to spend $8 million in checkpoint grants statewide. That effort began Dec. 18 with more than 250 checkpoints scheduled around the state between then and New Year’s weekend.
In Orange County, a dozen cities will receive a total of about $420,500 for checkpoints this month and throughout 2010. To get the money, they had to agree to staff at least one checkpoint a month, as well as a bigger push to fight drunken driving during the winter holidays and again around Labor Day weekend.
As previously reported, a Costa Mesa DUI Checkpoint will be run on December 29, 2009, in Costa Mesa. Also, on Dec. 31, DUI saturation patrols are scheduled from 8 p.m. through 3 a.m. in Anaheim. In Aliso Viejo, a DUI checkpoint is scheduled from 7 p.m. Dec. 31 to 3 a.m. Jan. 2.

Orange County police agencies began a special 17-day DUI enforcement period on Dec. 18 that will last until Jan. 3 to crack down on drunken driving.
The operation is part of a statewide effort to enforce laws pertaining to motorists driving under the influence of alcohol or drugs made possible by AVOID  A Multi-Agency DUI Task Force.
On the first weekend of enforcement, Dec. 18 through Dec. 20, there were a total of 31 DUI arrests in Orange County.
During the holiday enforcement period, Orange County law enforcement officers will use sobriety checkpoints and saturation patrols throughout the county to make the streets safer for drivers.
Other increased enforcement periods include mid-August through Labor Day weekend, Memorial Day weekend, Independence Day weekend, Halloween, Super Bowl Sunday, St. Patrick’s Day and Cinco de Mayo.
Law enforcement officers suggest that all community members can help by keeping an eye out for drunken drivers. Signs to look for in a suspected drunken driver include car swerving, driving too fast or slow, braking for no reason, driving with no headlights at night, or signaling one way and turning the other. If you feel you may have witnessed someone driving drunk, call 9-1-1.

The Orange County Register today had a story about Deputy Dallas Hennessey, who has been named as Lake Forest Deputy of the Year. Hennessey, a 10-year Orange County Sheriff’s Department veteran, in 2008 was honored by Mothers Against Drunk Driving for having the highest number of arrests among sheriff contract cities in the county. Since coming to Lake Forest in 2007, Hennessey has consistently been honored for his record arrests three years in a row. In 2008, more than 2,500 drivers were arrested for drunken driving countywide.
Hennessey  a drug recognition expert  has catching drunken drivers down to an art. In 2007, he arrested 111, becoming the department’s only deputy who has generated more than 100 arrests in one year.
Police services in Lake Forest have taken advantage of the deputy’s keen eye to continue an effort to take drunken drivers off the streets. In 2007, Lake Forest led cities that contract with the Sheriff’s Department in the number in DUI arrests, with 266. Stanton followed as a distant second with 188, and Dana Point reported 182.
Among Hennessey’s other accomplishments is his work as part of a special enforcement team. In this role, Hennessey, is part of an anti-tagging program. In 1½ years he and his partners have cleared out more than 100 cases and made more than 40 arrests. He is also active in community education and is a master instructor in the use of Taser and has testified as an expert in court.
“He is very involved and dedicated to the community,” said Lt. Doug Doyle, chief of police services for the city. “He produced an incredible body of work this year and he consistently far exceeds expectations in every area of his responsibilities.”

Fullerton police have announced a DUI checkpoint in Fullerton for December 26th. Costa Mesa has one set for December 29, 2009, in Costa Mesa.
