Orange County Memorial Day DUI Checkpoint Locations

Our Orange County DUI Lawyers have received a request from the OC Sheriff’s Department to help spread the word about their Memorial Day Weekend Schedule of Operations, including both DUI checkpoints and Roving Patrols.

DUI Checkpoints:

FRIDAY, May 28:

Orange County Sheriff’s Department (City of Laguna Woods)

Brea Police Department

La Habra Police Department

In addition, the Huntington Beach PD is conducting their own DUI Checkpoint, at Pacific Coast Highway at Huntington Street, City of Huntington Beach on  May 29, 2010, starting at 9pm.

Saturation Patrols:

FRIDAY – MONDAY, May 28-31:  The Orange County Sheriff’s Department will conduct DUI Roving Patrols in their south contract cities.

DUI Roving Patrols will also be conducted by police in the following cities:

Anaheim,

Buena Park,

Fountain Valley,

Fullerton,

Irvine,

La Habra,

Orange,

Placentia,

Seal Beach,

Tustin,

Westminster

UCI Campus police.

The AVOID Program seeks to publicize the combined DUI enforcement efforts of all participating law enforcement agencies to raise awareness of the increasing problems associated with drinking and driving. These efforts are focused especially during the holiday periods throughout the year when drinking and driving appears to increase.

Murrieta DUI Checkpoint

The Murrieta Police Department announced today they will be holding a DUI/Driver’s License checkpoint on Friday May 28th from 1800-0200, in the City of Murrieta.

Orange County Memorial Day DUI Checkpoint Locations

Lindsay Lohan has been an active participant in the celebrity news cycle throughout her Hollywood career. A new scandal or piece of juicy gossip about the young actress seems to emerge every week or two, reminding us how calm most of our lives are in comparison.

But a recent turn has taken Lohan from the world of L.A. gossip to serious legal tangle, as she had to appear in court after pleading guilty to misdemeanor drug charges and no contest to three driving charges in 2007. She was given probation at the time.

Now, a judge has ordered that Lohan must wear an alcohol-monitoring bracelet, and submit to drug testing in the L.A. every week, the San Jose Mercury News is reporting.  The SCRAM bracelets, as they are called, measure alcohol through the skin, and report the presence of alcohol to a separate machine.

At first, Lohan’s lawyer attempted to contest the ruling that her client had to wear a bracelet. The judge responded that she would be happy to spend the next half an hour listing reasons that she is requiring Lohan to wear the bracelet tracking her blood alcohol content.  The lawyer accepted that as basis enough to continue without further challenge.

The judge also ordered an alcohol education program for the starlet.

Her appearance in court recently was to address the fact that Lohan, had missed an appointment to appear in court last week for a progress report on her probation. On the day that she was supposed to be in Beverly Hills for that progress report, she was actually in Cannes, France, partying at the Cannes Film Festival. A warrant for her arrest was sent out, though it was recalled after Lohan posted bail.

Lohan’s lawyer claimed that her passport had been stolen while she was in France, and that it prevented her from getting on a flight from France.

The weekly drug testing could jeopardize a movie project that Lohan was scheduled to film in Texas. When presented with this information, the judge suggested that the project would have to wait.

Lohan spent several hours after the court session, waiting to have the alcohol-monitoring bracelet put on. She will have to wear the bracelet at least until her next hearing, which will take place in July.

While ignition interlock devices are common penalties for a Los Angeles DUI arrest, alcohol monitoring bracelets are less common. However, this high-profile case has brought them to the attention of the public at large, and even some mothers have an interest in using them to keep tabs on their teenagers.

Steps such as these are still a ways off, however, as the bracelet is not widely available, although many Orange County DUI Lawyers have been using them for years to avoid mandatory jail time for clients.

Orange County Memorial Day DUI Checkpoint Locations

San Clemente resident James Neal, 56, a former NASCAR driver plead guilty Tuesday after leading deputies on a high speed chase in his Corvette in the early hours during the morning of May 17. Neal has been sentenced to one month in jail and probation.

According to Orange County sheriff’s spokesman Jim Amormino, deputies initially tried to pull Neal over at 3 a.m. for a minor infraction while the 56-year-old was heading southbound on Interstate 5 in San Clemente. However, Neal sped off in an attempt to evade deputies and reached speeds of about 140 mph.

Deputies followed Neal for about five to six minutes to the Border Patrol checkpoint at the edge of San Diego County, but lost sight of the car. CHP officers then took over the pursuit once deputies had lost Neal.

According to reports, Neal was arrested in San Diego County near the La Jolla area after the engine of his 2003 Corvette blew up.

Deputies arrested Neal without a struggle wherein the San Clemente resident was then booked into Orange County Jail with bail set at $25,000.

NASCAR officials said Neal was a NASCAR track racer at the old Ascot Park track in the city of Gardena in the early 1980s. However, Neal had never won a national race.

Orange County Memorial Day DUI Checkpoint Locations

Sargeant Burdette of the Newport Beach Police Department put out a press release, sent to our Orange County DUI Lawyers, regarding a Newport Beach DUI Checkpoint on Saturday night.

The Traffic Division of the Newport Beach Police Department will be conducting a sobriety/driver’s license checkpoint on Saturday May 22, 2010.  The location of the checkpoint will be northbound Newport Blvd. at Finley Ave.  The approximate hours of operation will be from 9:00 p.m. until 3:00 a.m.

Statistics show that DUI checkpoints are one of the worst ways to find drunk drivers, but they are popular with police.  Why?  Because they can mean serious money to the police departments that have them.  Federal money, MADD contributions, and especially impound fees for unlicensed drivers, add up, while the real drunk drivers, which can be better apprehended using targeted patrols, can easily avoid the checkpoints and continue to drive.

Orange County Memorial Day DUI Checkpoint Locations

Our Orange County DUI Lawyers have discovered some interesting facts about the recent Costa Mesa police DUI checkpoint.  Despite more than 1,000 persons passing through the checkpoint, the Costa Mesa Police Department only arrested one person at a DUI checkpoint Friday night on Bristol Street.

Police stopped 503 of the more than 1,000 vehicles that passed through the stop. Officers investigated 46 people for possible DUI but arrested none on suspicion of driving drunk, officials said.

Four vehicles were towed, 15 were impounded and 35 people were given tickets.

Funding for the checkpoint was provided by the California Office of Traffic Safety.

From the OC Register:

COSTA MESA – Police issued 35 citations, impounded 15 cars and made one arrest during a police sobriety checkpoint Friday on Bristol Street north of Bear Street.

There were no drunken driving arrests made. The checkpoints are conducted to remove impaired drivers off the road and bring awareness to the dangers of driving under the influence of drugs/alcohol and driving without a license.

NEWPORT BEACH – Police arrested five drunken drivers and one drunken passenger in a DUI checkpoint on Friday night.  The checkpoint was held near the Fashion Island shopping center on northbound Jamboree Road and Santa Barbara Drive from 8 p.m. until 2 a.m. Police checked for drunken drivers and unlicensed drivers. Twelve drivers were cited for not having licenses and two marijuana citations were issued, said Sgt. Evan Sailor. More than 10 vehicles were towed.

What was interesting about this DUI checkpoint, from the standpoint of our Orange County DUI Lawyers, is that it was not announced.  The Ingersoll decision (and constitutional due process considerations), require notice to the public.  This might make this checkpoint lead to exclusion of evidence, which can mean dismissal for DUI defendants.

Orange County Memorial Day DUI Checkpoint Locations

The Menifee Police will conduct a sobriety and driver’s license checkpoint on Friday, May 7, 2010, from 6:00 PM to 2:00 AM, in the City of Menifee.  Officers will screen drivers passing through the checkpoint for sobriety and for a valid driver’s license. Drivers found to be under the influence of alcohol or other drugs will be arrested, and unlicensed drivers may be cited and have their cars towed

“DUI arrests can be embarrassing and expensive, but they’re easy to prevent,” said Sgt. Lingo. “If you’re drinking, hand your keys over to a designated sober driver, or call a taxi or sober friend for a ride home. Don’t risk an arrest —or worse, a serious injury or even death.”

The checkpoint will serve as a reminder to use designated drivers and not drink and drive.

Funding for this checkpoint comes from the California Office of Traffic Safety through the National Highway Transportation Safety Administration.
