Our Los Angeles DUI Lawyers have learned that actress Estella Warren has received what the Australian press is calling the “DUI Plea Deal of the Century”

The Planet of the Apes star allegedly crashed into three cars, attacked a police officer and then escaped custody while she was being booked back in May.

She was recaptured and charged with DUI, hit-and-run driving, battery on a cop and resisting arrest.

But Warren has avoided possible jail time after striking a deal with Los Angeles City prosecutors.

According to TMZ.com, she has agreed to plead guilty to DUI and the remaining three charges against her have been dropped.

Warren has also been sentenced to 60 months of summary probation and ordered to pay over $US1900 ($A1838) in costs and penalties.

And the actress tells the gossip site she’s glad to put the case to rest.

“I take my actions and their consequences very seriously. I can’t express enough how grateful I am that no one was injured or hurt. Moving forward I am focusing all my efforts on my career, my family and being a good influence to others.”

That’s fairly good, but not the deal of the century.  Los Angeles DUI cases are a little more negotiable than those in Orange County.

A little bit misleading, as Newport Beach doesn’t have a checkpoint tonight, (August 26, 2011), just roving patrols.

However, Santa Ana has a DUI checkpoint tonight.
Garden Grove, and Buena Park have DUI checkpoints tomorrow.
Irvine has a roving patrol tonight, and Anaheim does also.
Anaheim has a roving patrol tomorrow.

As the communicator of all things Orange County DUI related, I’ve learned that the Santa Ana Police Department will be conducting a series of activities during the mobilization to apprehend impaired drivers. These will include the use of saturation patrols out driving and looking for drunk drivers in Orange County, and DUI checkpoints.

Enforcement activities will begin on Friday August 19th with a DUI saturation patrol. Ten officers will be deployed throughout the city actively looking for impaired drivers. These saturation patrols will continue throughout the mobilization period. On August 26th, and September 3rd Santa Ana Police will be conducting DUI checkpoints.

As an Orange County DUI Lawyer that keeps on top of DUI trends, I notice that one of the biggest terms that people use to find my DUI Blog is Celebrity DUI arrests.  A few examples 2011, and then from from the last few years:

1. Estella Warren

Don’t brawl with the cops after being pulled over for a DUI. The “Planet of the Apes” star was charged with the extra offenses of battery on a police officer and resisting arrest after she allegedly popped an officer in the face when she was detained.  And her bail was $100,000.

Instead, take a page from Samantha Ronson, Lindsay Lohan’s ex-flame. Ronson reportedly cooperated with police and was released from jail without bail a couple of hours later.

2. Rick Springfield

Just being a tad over the legal limit still blows. The daytime-drama star was pulled over in his Corvette for speeding and received a DUI charge for driving with a blood-alcohol content (BAC) level of 0.10 percent. The legal limit in California is 0.08 percent. The 0.02 percent difference is the equivalent of licking the beer sweat off a pint glass, so watch your alcohol intake. You’re probably drunker (under the law) than you think, or if you’re just under the limit, it’s not going to take much to put you over the limit.  Note that breathalyzers are allowed up to a .02% margin of error, so the “over the limit” test, may have been at the legal limit.

3. Matthew Rutler

On the other hand, taking a BAC test could save you from a DUI even if you appear drunk. DUI charges were dropped against Rutler, Christina Aguilera’s boy-toy, after his BAC level was found to be at 0.06 percent. Rutler had originally been pulled over for driving erratically and arrested. You have the right to request a BAC test if you believe you aren’t intoxicated, but proceed at your own risk (see Rick Springfield above).

4. Jaime Pressly

Don’t mix your drinks with driving and divorce (or any) drama – research has shown that depression and stress could increase your BAC level.

The pint-sized, 110 lbs.-soaking-wet actress was in the midst of a highly-publicized divorce when authorities pulled her over for suspected DUI. Pressly’s BAC level was reportedly three times higher than the legal limit. Maybe it was the stress, her size, or one-too-many; either way, stay away from drinks, driving and drama (DDD) and get a DD (designated driver).

5. Adam Kennedy

The second baseman may be playing for the Seattle Mariners now, but he was in town in January when he was arrested on suspicion of DUI. Even though the Emerald City is his new home, the ex-Anaheim Angel still has to report to his former homebase for court appearances. As Kennedy has now figured out, don’t take it on the road, or you’ll have to keep coming back.

The main moral of celebrity DUI stories? Get a DUI Specialist to help you.  The DUI consequences will probably be worse for you if you’re not a celebrity.

The above cases were just from 2011 (so far).  The cases below are from the past few years:

Anna Nicole Smith

There are few people that have not heard of Anna Nicole Smith. The buxom blond, rest in peace, was a Playboy Playmate, a film and television star, and like many celebrities, died a tragic death due to a drug overdose. Her mug shot for Dui is another classic after she was arrested in Texas in 1989.

Shemar Moore

A longtime fan of the television show “Criminal Minds” I remember when Moore was arrested in Los Angeles for DUI. His arrest came shortly after starting on the show. Before “Criminal Minds” Moore is best know for his performance on the soap opera “The Young and the Restless.”

Vivica A Fox

Who can forget the appalling behavior this African-American beauty showed when she was pulled over in Los Angeles for speeding. After smelling alcohol on her breath the officer then found her to be over the legal limit and she was arrested.

She did not go down without a fight, verbally abusing the Caucasian police officer and accusing him of racism.

Celebrities are not role models. Enjoy their movies and do not get wrapped up in trying to be like them.  Mel Gibson-Gibson’s drunk driving might have been run of the mill-if not for the racist rampage he unleashed on the cop. Gibson’s anti-Jewish slurs made headlines for weeks.

Khloe Kardashian-The reality star and famous sister wasn’t the only one upset by her DUI. When Donald Trump found out about it, he kicked her off of Celebrity Apprentice.

Nick Nolte-The most notable thing about Nick Nolte’s DUI was the resulting mug shot. The wild-man hair and his dazed expression caused the photo to go viral, and it still tops the lists of most bizarre mug shots all over the Internet.

Haley Joel Osment-It seems like only yesterday he was the wide-eyed kid star of The Sixth Sense, but he’s all grown up now. Instead of seeing dead people, he was seeing double-and has the DUI record to prove it.

Charles Barkley-Not only did a drunken Barkley explain to the officer that he was in a hurry because he was on his way to get oral sex, he offered to tattoo the cop’s face on his own rear end. Not surprisingly, the cop called the play well, benching Barkley with a DUI charge.

Our Criminal Lawyers Orange have learned that the Avoid the 38 Orange County DUI Task Force today announced it will join nearly 10,000 other law enforcement agencies nationwide in support of an intensive crackdown on impaired driving August 19 through September 5, known as “Drive Sober or Get Pulled Over”.

As a DUI specialist Orange County, I get asked a lot whether or not it’s better to take a breath test, or a blood test, and I usually give the advice to choose breath.  (Although there is a split of opinion on that, and some attorneys recommend blood).  The presence of mouth alcohol, temperature, partition ratios, and the math effort used to convert breath to a blood alcohol level gives some room for argument.

One of the best ways to lower a breath test, however, is to hyperventilate, which cools the airways and, as breathalyzers are temperature dependent, makes for a lower test.  The academic studies seem to bear this out:

“…a group of men drank moderate doses of alcohol and their blood-alcohol levels were then measured by gas chromatographic analysis of their breath. The breathing techniques were then varied.The results indicated that holding your breath for 30 seconds before exhaling increased the blood-alcohol concentration (BAC) by 15.7%. Hyperventilating for 20 seconds immediately before the analyses of breath, on the other hand, decreased the blood-alcohol level by 10.6%. Keeping the mouth closed for five minutes and using shallow nasal breathing resulted in increasing the BAC by 7.3%, and testing after a slow, 20-second exhalation increased levels by 2%. “How Breathing Techniques Can Influence the Results of Breath-Alcohol Analyses”, 22(4) Medical Science and the Law275.For another study with similar findings, see “Accurate Measurement of Blood Alcohol Concentration with Isothermal Breathing”, 51(1) Journal of Studies on Alcohol 6.

Dr. Michael Hlastala, Professor of Physiology, Biophysics and Medicine at the University of Washington has gone farther and concluded:

“By far, the most overlooked error in breath testing for alcohol is the pattern of breathing….The concentration of alcohol changes considerably during the breath…The first part of the breath, after discarding the dead space, has an alcohol concentration much lower than the equivalent BAC. Whereas, the last part of the breath has an alcohol concentration that is much higher than the equivalent BAC. The last part of the breath can be over 50% above the alcohol level….Thus, a breath tester reading of 0.14% taken from the last part of the breath may indicate that the blood level is only 0.09%.” 9(6) The Champion 16 (1985).

The one thing that seems pretty clear is that holding your breath (which police sometimes ask you to do) results in a much higher test.  That can make the difference between being over the limit and under the limit.  Be careful out there, and if you need an attorney, my number is (877) 568-2977.

Our Newport Beach DUI Lawyers have learned directly from the Traffic Division of the Newport Beach Police Department that they will be conducting a sobriety/driver’s license checkpoint on Friday, August 12, 2011. The location of the checkpoint will be northbound Dover Drive at 16th Street. The approximate hours of operation will be from 9:00 p.m. until 3:00 a.m.

The checkpoint location was selected based upon its proximity to bars and restaurants and provides a high degree of visibility to the motoring public. Site determination was also based upon roadway configuration, sight distances, traffic volume, lighting, and motorist safety. A primary consideration was also officer safety.

The checkpoint will be clearly marked and vehicles will be selected to move through the check lanes on a pre-set basis to ensure objectivity and timeliness, according to the police agency.

Checkpoints do not necessarily produce dramatic increases in arrests, as we have reported previously.

Another Celebrity DUI arrest!  Ex-Lindsay Lohan lover Samantha Ronson’s DUI arrest on Monday has made headlines, partially because of the mugshot that came out of the ordeal. Ronson was arrested after she was pulled over in Baker, California.

Ronson, 33, was driving a Porsche. Officers at first stopped her because of her driving speed. She had been going about 19 miles above the posted speed limit of 70 miles per hour.

Well, once pulled over, officers suspected that she was also under the influence, reportsUS Weekly.

The arresting officers gave her a balance test. The DJ showed some signs of being intoxicated at the time, according to US Weekly. She was then arrested after she refused a breathalyzer test, though reports are that while at the police station she tested above the legal limit, the Los Angeles Times reports.

Officers say that she was both friendly and cooperative with law enforcement during the arrest. Maybe her generally congenial attitude towards her arrest is why she was able to crack a half-smile in her mugshot photo.

Ronson admitted that she had been drinking alcohol earlier. She was arrested at around 10:30 a.m. Monday morning, and claimed that she had been drinking late that night or possibly early in the morning, and was on her way home from Las Vegas when she was pulled over, reports Us Weekly.

Will Ronson get leniency with this recent run-in with the law? Maybe, if she doesn’t have a prior history of drunk driving. Though, for sure, Samantha Ronson’s DUI seems to pale in comparison with her famous ex’s legal woes: Lindsay Lohan has gotten into a whole lot of trouble with the law for drugs, alcohol, and shoplifting. While Ronson was arrested, she was released the same day, reports US Weekly.

We looked at the booking sheet and made note of the fact that Ronson, who’s listed as 5’7″ and weighing 102 pounds, was pulled over for speeding in her black Porsche around mid-morning.  The arresting officers administered a field sobriety test which Ronson failed at abysmally, and when they pulled out a breathalyzer, she adamantly refused, prompting her immediate arrest.

Ronson had just left Palazzo Hotel’s Lavo nightclub in Las Vegas where she had a gig the night before.  Maybe you’re not a celebrity arrested for DUI (or dumb enough to drive drunk 200 miles from Las Vegas at 10am), but if you need the services of our Newport Beach DUI Lawyers, call anytime at (8777) 568-2977.

Our Orange County DUI Lawyers have learned that a 23-year-old man is in custody at a local hospital after a fatal single car traffic collision at Malvern and Woods in Fullerton the morning of July 24th, 2011. Arrested for felony DUI was Justin Drake. He is still being treated at the hospital for his injuries during the collision. He is in police custody. Fullerton Police Sgt. Andrew Goodrich said that Drake was driving a 2006 Mazda westbound on Malvern in the area of Woods at a high rate of speed this morning. He lost control of the vehicle at the curve in the road, and struck a tree and a retaining wall. His female passenger was critically injured and transported to a local trauma center. She was pronounced dead this morning, dying from injuries sustained in the collision. Her identity is not being released at this time. The preliminary investigation indicates that the Drake was under the influence of alcohol.
