Buena Park Police Department Traffic Unit will be conducting a DUI/Drivers License Checkpoint on May 18, 2012, on the 8000 block of La Palma Ave, within the city limits between the hours of 7 p.m. and 2 a.m.

Officers will be contacting drivers passing through the checkpoint for signs of alcohol and/or drug impairment. Officers will also check for proper licensing and will strive to delay motorists only momentarily. Drivers caught driving impaired can expect jail, license suspension, and insurance increases, as well as fines, fees, DUI classes, other expenses that can exceed $10,000.

“Over the course of the past three years, DUI collisions have claimed 11 lives and resulted in 718 crashes injuring 88 members of our community,” said Sgt. Nunez.

According to the National Highway Traffic Safety Administration (NHTSA), checkpoints have provided the most effective documented results of any of the DUI enforcement strategies, while also yielding considerable cost savings of $6 for every $1 spent. Checkpoints are placed in locations that have the greatest opportunity for achieving drunk and drugged driving deterrence and provide the greatest safety for officers and the public.

“Deaths from drunk and drug-impaired driving are going down in California,” said Christopher J. Murphy, Director of the California Office of Traffic Safety (OTS). “But that still means that hundreds of our friends, family and co-workers are killed each year, along with tens of thousands who are seriously injured. We must all continue to work together to bring an end to these tragedies. If you see a Drunk Driver – Call 9-1-1.”

Funding for this checkpoint is provided to Buena Park Police Department by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration, targeting those who still don’t heed the message to designate a sober driver.

In Ingersoll v. Palmer…the landmark DUI checkpoint case…the California Supreme Court ruled that sobriety checkpoints must adhere to specific requirements in order to be constitutionally recognized.

If they do not, your California DUI defense attorney may be able to have your DUI charges reduced or even dismissed. These requirements relate to:

• who makes decisions with respect to the operation of California sobriety checkpoints,
• when and how DUI roadblocks are operated, and
• how intrusive the procedures are to those stopped at a DUI checkpoint.

Costa Mesa police conducted the checkpoint between 8 p.m. Saturday and 2 a.m. Sunday on Harbor Boulevard and Peterson Place.

Don't finish the tray before heading into an Orange County DUI Checkpoint

Nearly 2,500 vehicles went through the checkpoint and about 300 vehicles were screened, police said.

Police said seven people were arrested on suspicion of driving under the influence of alcohol and one person was arrested on suspicion of driving under the influence of drugs.

Other arrests included six people who were cited or arrested for operating an unlicensed vehicle or while driving with a suspended or revoked license.

Three other drivers were cited for vehicle code violations.

The checkpoint location was selected based upon its proximity to bars and restaurants.  The film festival, plus good weather, might make this a productive one for them, even though, as I’ve mentioned in the past, DUI checkpoints in Orange County and elsewhere don’t significantly catch many people DUI, or lead to an increase in Orange County DUI arrests.

have been tipped off that the Santa Ana Police Department will conduct a DUI/drivers License checkpoint on Friday, April 27. It will run from 7:30 p.m. to 1:30 a.m. in the area of 2300 W. 5th Street.

Traffic volume and weather permitting, all vehicles may be checked ,and drivers who are under the influence of alcohol and/or drugs will be arrested.  Best to avoid it entirely.  But if you do need a DUI specialist, call me at (877) 568-2977

A night on the town could be a thing of the past

As a DUI Lawyer in Orange County, I try to keep ahead of developments in breath and blood testing.  But technology from the automotive world might be a game changer as far as how DUI s might be handled, or prevented, in the future.

Several automotive manufacturers have been meeting with, partnering with, and developing experimental technology to detect alcohol, including alcohol emitted from the skin in sweat through the steering wheel, or from the breath.

In 2008, the National Highway Traffic Safety Administration (NHTSA) launched a 5-year campaign to develop ignition interlocks as standard equipment in all vehicles. NHTSA and the Automotive Coalition for Traffic Safety—which is funded by auto manufacturers—have budgeted $10 million to solicit research and development on the widespread use of this in-vehicle technology.

Mothers Against Drunk Driving (MADD) has asked Congress for another $60 million to be allotted annually for alcohol detector development.  So there is big money behind this.

The group opposing this?  It’s the American Beverage Institute, which fears this would prevent people from going out for even one drink.  Of course, as my fellow Orange County DUI Lawyers know, a machine is only as accurate as the maintenance, calibration and margin of error for the device allows it to be, assuming no deviations from standards.  Garbage in, garbage out, as they say, and in this case, a false positive or machine malfunction could have serious consequences to the driver.  The Beverage Institute’s newsroom is here at:  http://abionline.org/newsroom.cfm?t=inthenews
