<p class="MsoNormal">California Penal Code 261, or rape, is defined as the forced act of sexual intercourse.<span> </span>There are many variables that fall under this penal code as well, including forced intercourse with a foreign object, forced oral copulation, statutory rape and date rape.<span> </span>Being accused of Penal Code 261 is frightening, and it’s important to contact criminal lawyers, Orange County or otherwise, as soon as you have been accused.</p>

<p class="MsoNormal">If the alleged victim gave his or her consent to the sexual intercourse, the accused is not guilty of rape.<span> </span>Many times, a victim will claim that he or she gave their consent at the beginning but then changed their mind.<span> </span>However, if the victim did not clearly communicate that they no longer wanted to participate in the sexual act, the accused is still not guilty of rape since he or she did not know the victim had changed their mind.</p>

<p class="MsoNormal"><strong>False Accusations: </strong></p>
<p class="MsoNormal">
<p class="MsoNormal">As with other crimes, rape is often claimed by ‘victims’ out of jealousy, rage, or other reasons as a means to ‘get back’ at the accused.<span> </span>This is unfortunate, but it happens all the time. If this is the case, an attorney will compile evidence which points to this fact and will convey this to the judge and jury.<span> </span>Things that will be considered are other rape allegations from the same ‘victim’ pointing at other individuals, the circumstances surrounding the case, etc.</p>

<p class="MsoNormal">Unfortunately, many rapes occur at night and in conditions where it is difficult for the victim to actually see his or her attacker. Many different things can affect a victim’s ability to correctly identify an attacker, such as low light, prejudice in photo or police officer line-ups, face coverings, poor vision and many other things.<span> </span>Many individuals have been released from custody after having been proven innocent through DNA evidence of rape crimes they were convicted of.<span> </span>This is one reason why contacting an attorney right away is so important.</p>

<p>HUNTINGTON BEACH &#8211; A suspected drunken driver  rear-ended a Huntington Beach police patrol car tonight, leaving an  officer with neck and back injuries, according to the California Highway  Patrol.</p>
<p>The accident occurred just after 11 p.m. on Beach Boulevard  just north of Slater Avenue, according to the CHP. The officer was  issuing a citation inside his parked patrol cruiser when a man driving a  Toyota Camry crashed into the back of his vehicle, said CHP Officer  Jason Montoya.</p>
<p>The officer was taken to a hospital with neck and back pain,  Montoya said.</p>
<p>The driver was taken into custody on suspicion of DUI, Montoya  said.</p>

<p>I was contacted by the owner of a DUI blog in Tampa Florida, who runs the Fight your DUI blog, and thought I&#8217;d give a shout out to what seems to be a well written blog in the field of DUI Defense.</p>
<p>I always think it&#8217;s funny that, since my law firm is in Orange County California, and I advertise our services as <a href="http://www.expertlawfirm.com">Orange County DUI Lawyers</a>,  that I get a lot of Florida calls, as there&#8217;s an Orange County, Florida and sometimes the distinction is not made in a quick internet search.  (Note also a bit of trivia:  Both Disneyland USA parks are in Orange County, just in different states).</p>
<p>So, now I have a contact in at least one area in Florida &#8211; for anyone that needs a <a href="http://www.fightyourdui.com/Blog.aspx">Tampa DUI Attorney</a>.</p>

<blockquote><p>The Seal Beach Police Department will be conducting a DUI/Drivers  License checkpoint on<strong> Saturday, March 13, 2010, from 8pm to 3am on  Pacific Coast Highway between Anderson and Seal Beach Blvd.</strong> In an effort  to reduce the number of persons killed and injured in alcohol involved  crashes, DUI checkpoints are conducted to identify offenders and get  them off the street, as well as educate the public on the dangers of  impaired driving.</p>
<p>All too often, members of our community are senselessly injured or  killed on local roadways by impaired drivers. This DUI/Drivers License  checkpoint is an effort to reduce those tragedies, as well as insuring  drivers have a valid driver’s license.  A major component of these  checkpoints is to increase awareness of the dangers of impaired driving  and to encourage sober designated drivers.<br />
A DUI checkpoint is a proven effective method for achieving this goal.  By publicizing these enforcement and education efforts, The Seal Beach  Police Department believes motorists can be deterred from drinking and  driving.</p>
<p>Traffic volume and weather permitting, all vehicles may be checked  and drivers who are under the influence of alcohol and/or drugs will be  arrested. Our objective is to send a clear message to those who are  considering driving a motor vehicle after consuming alcohol and/or drugs  – Drunk Driving, Over the Limit, Under Arrest. The public is encouraged  to help keep roadways safe by calling 911 if they see a suspected  impaired driver.</p>

<p>Our <a href="http://www.expertlawfirm.com">Orange County DUI Lawyers</a> were notified of an Orange County DUI Roving Patrol announcement, which may lead to Orange County DUI arrests.  The “Avoid the 12” DUI Task Force will be conducting DUI roving patrols<strong> in the cities of Lake Forest, Mission Viejo and Rancho Santa Margarita on Friday, March 5, 2010. </strong></p>
<p>A roving patrol is where officers drive, looking for persons exhibiting driving behaviors correlated with driving under the influence, and investigate further.  Roving patrols are more effective than DUI checkpoints, as they correlate with actual driving observed.  The goal of the program is to btain federal funding available, volunteers and funding from MADD, and increase funding through impound fees.</p>
<p>Funding for this program is provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.</p>

<p>Our Criminal Lawyers Riverside have learned that the Lake Elsinore Police Department will be conducting a DUI /  Driver’s License Checkpoint on Saturday March 06, at an undisclosed  location within the city.</p>
<p>A DUI checkpoint is not a proven effective method for achieving the goal of getting drunk drivers off the street, but by publicizing these enforcement and education efforts, The Lake  Elsinore Police Department believes motorists can be deterred from  drinking and driving.</p>
<p>Traffic volume and weather permitting, all vehicles may be checked  and drivers who are under the influence of alcohol and/or drugs will be  arrested.</p>
<p>Funding for this operation is provided by a grant from the California  Office of Traffic Safety, through the National Highway Traffic Safety  Administration.</p>

<p>The Los Angeles Police Department announced a <a href="http://losangeles.expertlawfirm.com/">Los Angeles DUI</a> checkpoint for March 5, 2010, as follows:</p>
<p>What: Sobriety &amp; Drivers License Checkpoint</p>
<p>When: Friday, March 5, 2010 8:00 PM – 3:00 AM</p>
<p>Where:  Cahuenga Boulevard West Broadlawn Avenue North Hollywood,  California</p>
<p>Who: Emergency Operations Division</p>
<p>Why: The purpose of the sobriety checkpoint is to reduce the number  of traffic collisions involving intoxicated drivers and hit and run collisions.  In 2010, residents  residing in the North Hollywood Area endured 33 driving under the influence-related and 187  hit and run traffic collisions.   The checkpoint will educate the  community to use designated drivers and not drinkand drive.  Our message  is simple: If we catch you drunk, you will be arrested.</p>
<p>It is the Los Angeles Police Department’s goal to continue providing  public awareness on the dangers of drinking and driving, and the laws concerning driving without  a valid driver’s license. Motorists approaching a checkpoint will observe traffic signs,  information and police officers advising that a checkpoint is ahead.  Once diverted into a lane, each  motorist will be detained momentarily while an officer explains the purpose of the checkpoint.</p>
<p>Funding for this checkpoint is provided by the California Office of  Traffic Safety through the National Highway Transportation Safety Administration.</p>

<p>COSTA MESA An intoxicated pedestrian who walked up to a sobriety  checkpoint to see what was taking place was among five arrested Monday,  police said.</p>
<p>Police arrested Rodrigo Sajvin Cumes, 37, of Costa Mesa, on a public  intoxication charge after he went up to the checkpoint held on Harbor  Boulevard at Fair Drive, said Costa Mesa police Sgt. Phil Myers. Cumes  was so intoxicated that he could not care for his safety, according to  police.</p>
<p>Three people were arrested on suspicion of drunken driving and 15  citations were issued, police said. Police screened 633 cars out of  2,055 that went through the checkpoint.</p>
<p>Also, police said two drivers switched seats with passengers out of  fear of being arrested for driving under the influence. Those drivers  were not arrested, Myers said.</p>
