As an Orange County DUI Lawyer that keeps on top of DUI trends, I notice that one of the biggest terms that people use to find my DUI Blog is Celebrity DUI arrests. A few examples 2011, and then from from the last few years:
1. Estella Warren
Don’t brawl with the cops after being pulled over for a DUI. The “Planet of the Apes†star was charged with the extra offenses of battery on a police officer and resisting arrest after she allegedly popped an officer in the face when she was detained. And her bail was $100,000.
Instead, take a page from Samantha Ronson, Lindsay Lohan’s ex-flame. Ronson reportedly cooperated with police and was released from jail without bail a couple of hours later.
2. Rick Springfield
Just being a tad over the legal limit still blows. The daytime-drama star was pulled over in his Corvette for speeding and received a DUI charge for driving with a blood-alcohol content (BAC) level of 0.10 percent. The legal limit in California is 0.08 percent. The 0.02 percent difference is the equivalent of licking the beer sweat off a pint glass, so watch your alcohol intake. You’re probably drunker (under the law) than you think, or if you’re just under the limit, it’s not going to take much to put you over the limit. Note that breathalyzers are allowed up to a .02% margin of error, so the “over the limit” test, may have been at the legal limit.
3. Matthew Rutler
On the other hand, taking a BAC test could save you from a DUI even if you appear drunk. DUI charges were dropped against Rutler, Christina Aguilera’s boy-toy, after his BAC level was found to be at 0.06 percent. Rutler had originally been pulled over for driving erratically and arrested. You have the right to request a BAC test if you believe you aren’t intoxicated, but proceed at your own risk (see Rick Springfield above).
4. Jaime Pressly
Don’t mix your drinks with driving and divorce (or any) drama – research has shown that depression and stress could increase your BAC level.
The pint-sized, 110 lbs.-soaking-wet actress was in the midst of a highly-publicized divorce when authorities pulled her over for suspected DUI. Pressly’s BAC level was reportedly three times higher than the legal limit. Maybe it was the stress, her size, or one-too-many; either way, stay away from drinks, driving and drama (DDD) and get a DD (designated driver).
5. Adam Kennedy
The second baseman may be playing for the Seattle Mariners now, but he was in town in January when he was arrested on suspicion of DUI. Even though the Emerald City is his new home, the ex-Anaheim Angel still has to report to his former homebase for court appearances. As Kennedy has now figured out, don’t take it on the road, or you’ll have to keep coming back.
The main moral of celebrity DUI stories? Get a DUI Specialist to help you. The DUI consequences will probably be worse for you if you’re not a celebrity.
The above cases were just from 2011 (so far). The cases below are from the past few years:
Anna Nicole Smith
There are few people that have not heard of Anna Nicole Smith. The buxom blond, rest in peace, was a Playboy Playmate, a film and television star, and like many celebrities, died a tragic death due to a drug overdose. Her mug shot for Dui is another classic after she was arrested in Texas in 1989.
Shemar Moore
A longtime fan of the television show “Criminal Minds†I remember when Moore was arrested in Los Angeles for DUI. His arrest came shortly after starting on the show. Before “Criminal Minds†Moore is best know for his performance on the soap opera “The Young and the Restless.â€Â
Vivica A Fox
Who can forget the appalling behavior this African-American beauty showed when she was pulled over in Los Angeles for speeding. After smelling alcohol on her breath the officer then found her to be over the legal limit and she was arrested.
She did not go down without a fight, verbally abusing the Caucasian police officer and accusing him of racism.
Celebrities are not role models. Enjoy their movies and do not get wrapped up in trying to be like them. Mel Gibson-Gibson’s drunk driving might have been run of the mill-if not for the racist rampage he unleashed on the cop. Gibson’s anti-Jewish slurs made headlines for weeks.
Khloe Kardashian-The reality star and famous sister wasn’t the only one upset by her DUI. When Donald Trump found out about it, he kicked her off of Celebrity Apprentice.
Nick Nolte-The most notable thing about Nick Nolte’s DUI was the resulting mug shot. The wild-man hair and his dazed expression caused the photo to go viral, and it still tops the lists of most bizarre mug shots all over the Internet.
Haley Joel Osment-It seems like only yesterday he was the wide-eyed kid star of The Sixth Sense, but he’s all grown up now. Instead of seeing dead people, he was seeing double-and has the DUI record to prove it.
Charles Barkley-Not only did a drunken Barkley explain to the officer that he was in a hurry because he was on his way to get oral sex, he offered to tattoo the cop’s face on his own rear end. Not surprisingly, the cop called the play well, benching Barkley with a DUI charge.

Actor Chris Klein was arrested early Wednesday in Los Angeles on suspicion of drunken driving, officials said.
Klein, 31, best known for his role in the “American Pie” comedies, was taken into custody about 3:15 a.m., according to California Highway Patrol Officer Patrick Kimball.
Kimball said officers pulled Klein over after they spotted his black 1999 Chevrolet Blazer weaving across three lanes of traffic on the westbound 101 Freeway at Woodman Avenue.
The actor was booked at the Los Angeles Police Department’s Van Nuys station for driving under the influence of alcohol and released without bail, Kimball said.
Klein got his break in 1999′s “Election” and later played the character Oz in the “American Pie†comedies. His onetime relationship with actress Katie Holmes was frequent tabloid fodder.

The article below from a Houston newspaper was humorous, and shows the jury pool’s sentiment regarding Celebrity DUI cases. As Newport Beach DUI Lawyers, we get a lot of similar comments. Enjoy:
“I found DeWitt’s recent pleading of no contest to misdemeanor DUI particularly disappointing. Admittedly, I haven’t been paying much attention to her post-1984 career, and her mugshot only accentuates the lingering differences between her and Somers (DeWitt looks like a drunk 60-year old, Somers looks like the plastic surgery offspring of Courtney Love and Pam Anderson).
And the less said about Yasmine Bleeth, the better.
But DeWitt’s drunk driving arrest is just the latest (or almost latest) in a series of celebrity inebriated motoring arrests. I can’t really call them “scandals” because…nobody cares. Seriously, the sheer tonnage of Hollywood DUIs (referred to as “DWIs” here in Texas, in case you were confused) is like any other atrocity: the more you’re exposed to it, the less you care.
What I still don’t get, however, is why they keep happening.
Now, it’s pretty apparent that getting busted for drunk driving is only a hindrance to people like you and me. Actors, athletes, and politicians can bounce back with little or no negative repercussions from their boozy vehicular forays. Obviously a big part of why everybody from the A-list on down doesn’t worry a lot about getting nailed is because they assume they’ll remain marketable. Shia LaBeouf (arrested in 2008) starred in the biggest grossing movie of 2009 (and one of the top grossers of all time), while Michelle Rodriguez and Keifer Sutherland have maintained fairly lucrative careers following their own busts.
Now for some of these folks, I blame lack of funds sufficient to hire a personal driver. Granted, LaBeouf can’t really use this excuse, but Puck from The Real World? Jani Lane? Tawny Kitaen? They’re lucky to even own cars.
So it would appear there’s a significant link between a star’s particular career trajectory and their access to a limo service. Then again, one might assume a celebrity’s Q rating would figure prominently into their likelihood of arrest in the first place. Do you think Lethal Weapon 2 vintage Mel Gibson — or Melrose Place era Heather Locklear, for that matter — would’ve been cited if they were pulled over after a half dozen Bartles & James? Not bloody likely.
Indeed, when we look at recent arrests of this nature, the list looks like a “Where Are They Now” slideshow: DeWitt, Lane, and Kitaen are joined by Gary Collins, Haley Joel Osment, Nick Nolte, and Mischa Barton. All of whom were at one point perched on the fabled catbird’s seat, but have lately fallen on hard times. If history serves, we can probably kiss these folks days in the public eye goodbye. Though there are always exceptions to this rule (see Keanu Reeves (1993)).
Still, even the D-est of the D-listers in this category (hi, Andy Dick) should still have enough money to stock up on vodka, Red Bull, and prescription Percocet to stay in their own damn house. But there’s the quandary: quietly downing a 1.75 of Absolut in the privacy of your mansion doesn’t get your name on TMZ, and sensibly taking a cab or a limo home from the Viper Room won’t earn you much needed publicity, or that conciliatory spot on Oprah after your dutiful and totally sincere stint in rehab.
What we’re left with at the end of the day is the only rational explanation; celebrities, like they’ve been telling us (and we’ve secretly suspected) all along, are just better than us. The sooner we accept this, the sooner I can stop obsessively lurking on mughsots.com.
As for Joyce, she’ll be lucky to be invited back to the 30th reunion of Airplane II.

Actress Joyce DeWitt of “Three’s Company” fame will go it alone facing probation in a DUI case, our Newport Beach DUI Lawyers have learned.
The 61-year-old sitcom actress Joyce DeWitt pleaded no contest to a misdemeanor drunk driving incident from last year, the Los Angeles Times reports.
In general a no contest plea is similar to a plea of guilty. A plea of no contest can be advantageous for defendants where the effects of a plea of guilty may be too harsh. A no contest plea also generally cannot be used to the same extent as a guilty plea as evidence used against the accused in any civil suit for the same act.
One disadvantage of a no contest plea is that it often carries the same legal effect as a conviction for sentencing purposes. Though a defendant may hope for leniency during sentencing for saving the court the time and costs of a trial, one may risk receiving the same punishment without the opportunity to offer a defense or a chance for an acquittal from a jury.
In this DUI case, DeWitt was charged last July with two misdemeanor counts, driving under the influence and driving while having a 0.08% or higher blood alcohol level. Authorities say DeWitt’s blood alcohol was .15% — almost twice the legal limit.
She was arrested last year on the Fourth of July in El Segundo.
An officer said that DeWitt drove around a barricade intended to control vehicular traffic.
DeWitt pulled up in a black sports car, parked and staggered toward a police officer standing in uniform next to his motorcycle, witnesses said.
DeWitt was sentenced to three years probation and must attend a nine-month alcohol program.
Probation is the period during ”the probationer” is subject to critical examination and evaluation. The trial period must be completed before a person receives greater benefits or freedom.
In addition, DeWitt must pay a $510, plus penalty assessments.

actress Lindsay Lohan sought treatment after two California DUI arrests in Los Angeles.
Lindsay Lohan says that her time in alcohol rehabilitation has helped her turn her life around. She said, “I’m thankful for what I can take out of it. Now I feel clear.”
Lohan entered a rehab facility three times during 2007; in January to “take care” of her health, in May after an arrest for drunk driving in LA and again in August after another drunk driving episode. She left an alcohol and drug awareness program in October.
Lohan cites being “so alone” as the reason for clubbing as much as she did, and for its downward impact on her life. She now says she is happy and ready to move forward.

In July 2007 Lindsay Lohan was arrested for California DUI in LA after she jumped behind the wheel of an SUV and chased her assistant in a wild car chase following a late-night private party. The owner of the SUV and two passengers have filed charges of assault and battery against the actress over the event.
According to paperwork filed, Lohan and her assistant Taryn were arguing at the party. Taryn’s boyfriend, Dan, was behind the wheel of Dante Nigre’s 2004 Yukon Denali. He left the SUV to talk to Taryn, but she drove off and Lohan jumped into the driver’s seat in pursuit. Ronnie Blake and Jakon Sutter were in the back seat of the Denali and Nigre was in the passenger seat. At one point Blake managed to get out of the vehicle but Lohan accelerated and ran over his foot. She reportedly answered any pleas to stop with ‘hostile wrath’.
Lohan raced down Malibu’s Pacific Coast Highway, running stop signs and red lights, before coming to a stop in the parking lot of the Santa Monica Police Department. She was arrested for driving under the influence in Los Angeles after failing a field sobriety test. At the time Lohan denied driving the SUV, claiming Sutter was behind the wheel.
Blake, Sutter and Nigre claim violent jarring and whipping motions during the chase caused pain. They are seeking at least $50,000 for negligence, assault, battery, false imprisonment, emotional distress, trespass and slander. Lohan’s attorney asked why the men did not simply get out of the SUv, saying the actress stopped more than once during the episode.

Actor Shia LeBeouf was involved in accident and suspected of drunk driving in Los Angeles.
Citing ‘insufficient evidence’, the Los Angeles County District Attorney’s office said charges of driving under the influence in LA will not be filed against Shia LeBeouf.
LeBeouf was involved in an early morning accident in West Hollywood on July 27. His truck was flipped and he suffered severe injuries to his hand. Though initially arrested for suspicion of drunken driving in LA, Sheriff’s deputies later determined LeBoeuf was not at fault. Prosecutors are considering charges against the two in the other vehicle, who reportedly ran a red light.
Despite that decision not to file charges, the actor faces a 9-month suspension of his driver’s license because he refused to submit to a breath test. A License Administrative Hearing with the Department of Motor Vehicles is pending.
LeBoeuf, 22, starred in ‘Transformers’ and was in production for that movie’s sequel at the time of the accident.
