Orange County DUI Checkpoints – Costa Mesa

Our Orange County DUI Lawyers have learned that the Costa Mesa Police will be stopping cars at Bristol Street and Randolph Avenue from 6 to 11 p.m. Tuesday to check drivers’ licenses and look for drunk drivers.

Advance publicity of the DUI checkpoints is one of the criteria California courts use in determining the legality of a checkpoint if it ends up being challenged.

The high courts have not ruled on the legality of stopping cars to check for drivers’ licenses, but have upheld DUI checkpoints for two decades, even if they are not as effective as DUI roving patrols, our Newport Beach DUI Lawyers think.

Our Long Beach DUI Lawyers have learned that the Long Beach Police Department will be conducting a DUI/Driver License Checkpoint, Saturday, August 28, 2010, from 6:00 p.m. to 2:00 a.m. in the East Division.  In an effort to reduce the number of persons killed and injured in alcohol involved crashes, DUI checkpoints are conducted to identify offenders and get them off the street, as well as to educate the public on the dangers of impaired driving.

All too often, members of our community are senselessly injured or killed on local roadways by impaired drivers.  This DUI/Driver License Checkpoint is an effort to reduce those tragedies, ensure drivers have a valid driver license, and also to increase awareness of the dangers of impaired driving and encourage sober designated drivers.  A DUI Checkpoint is a proven effective method for achieving this goal.  By publicizing these enforcement and education efforts, the Long Beach Police Department believes motorists can be deterred from drinking and driving.

Traffic volume and weather permitting, all vehicles may be checked and drivers who are under the influence of alcohol and/or drugs will be arrested. Our objective is to send a clear message to those who are considering driving a motor vehicle after consuming alcohol and/or drugs – Drunk Driving, Over the Limit, Under Arrest.  The public is encouraged to help keep roadways safe by calling 911 if they see a suspected impaired driver.

Our Rancho Cucamonga Criminal Defense Attorneys have learned that a Driving Under The Influence And Drivers License Checkpoint  –8/27/2010, will take place in Rancho Cucamonga

On Friday, August 27, 2010 Deputies from the Rancho Cucamonga Police Department will be conducting a D.U.I. and Drivers License Checkpoint in the city of Rancho Cucamonga. The checkpoint will be conducted between the hours of 6 P.M and 2 A.M.

Deputies will be screening for intoxicated drivers and checking for valid drivers’ licenses. This operation is funded by a grand awarded to the City of Rancho Cucamonga by the California Office of Traffic Safety through National Highway Safety Administration, and in fact such funding can be a major source of cash for police agencies.

How to Clear My DUI Charges? Beat DUI Arrest Now!

Lawrence Taylor, in his excellent duiblog (duiblog.com), points out that “breathalyzers” do not measure alcohol: they actually measure the presence of a molecular group in chemical compounds. Ethyl alcohol (aka ethanol) contains the group, and so when the machine detects its presence (or, more accurately, infrared energy is absorbed by it), it simply assumes that the detected compound must be ethyl alcohol.

Problem: there are thousands of compounds containing the molecular group — of which well over one hundred have been found on the human breath.

Breathing gasoline or paint fumes, for example, or merely absorbing the fumes through the skin, can create false breath test results for days afterwards. And as Dean taylor has posted in the past, the problem is particularly acute when the suspect happens to be a diabetic, as diabetics often have high levels of acetone in their breath — a compound which contains the group in its molecular structure.

However, you do not need to be a diabetic to have high levels of acetone. Scientific research has established that acetone can exist in perfectly normal individuals at levels sufficient to cause false high breath-alcohol test readings.  See “Excretion of Low-Molecular Weight Volatile Substances in Human Breath: Focus on Endogenous Ethanol”, 9 Journal of Analytical Toxicology 246 (1985).

Fasting or radical dieting, such as with the Atkins diet, can also cause significantly elevated acetone. Studies have concluded that fasting, for example, can increase acetone in the body sufficient to obtain breathalyzer readings of .06%.  This is cumulative — that is, the .06% will be added by the machine to any levels actually caused by alcohol or other compounds.  Thus, a true breath alcohol of .03%, for example, would be reported by the machine as .09%. “The Likelihood of Acetone Interference in Breath Alcohol Measurement”, 3 Alcohol, Drugs and Driving 1 (1987).  And low-carbohydrate diets have long been associated with high levels of acetone production.

Of course, for many years law enforcement denied that any such problem existed.

How reliable are breathalyzers? Not very.

Our Newport Beach DUI Lawyers were told that three people were arrested on suspicion of driving under the influence of alcohol during a Saturday night police checkpoint, authorities said.

During the five-hour long checkpoint, police stopped 729 vehicles and conducted 16 field sobriety tests on the field, according to a statement released by the Laguna Beach Police.

More than 2,163 vehicles passed though the checkpoint, which was stationed on Pacific Coast Highway, near Vista Del Sol, meaning that the rate of capture for drivers under the influence is 0.0013%

According to the police statement, all drivers who were stopped were also given a brochure about the hazards of driving under the influence of alcohol.

Six drivers were also found to be unlicensed, and five additional drivers were issued citations for not carrying their license.

Four vehicles were also towed from the checkpoint, according to the police statement.

But officers at the checkpoint were not the only ones to have spotted drunk drivers Saturday night, according to police.

Outside of the checkpoint, five additional drivers were stopped and arrested on suspicion of driving under the influence.

The Memorial Day Weekend “Avoid the 38” – DUI Campaign concluded this past weekend with the deployment in Orange County of two Sobriety Checkpoints along with DUI Saturation Patrols focusing special attention towards drivers.  Our Newport Beach DUI Lawyers warned you about these DUI Checkpoint Locations in Orange County at the start of the Memorial Day holiday weekend.

From 12:01 AM Friday, May 28, 2010 through Midnight Monday, June 1, 2010 officers representing the “Avoid the 38” Task Force arrested 142 individuals for driving under the influence of alcohol or drugs in the State of California.   There were no DUI deaths reported during this time period.

(**NOTE: These numbers are only provisional with some agencies yet to report**)

Law enforcement officials will be conducting more “Avoid” anti-DUI efforts throughout the county and region during the July 4th weekend and the 18 day campaign in August ending Labor Day weekend.

Our Orange County DUI Lawyers have discovered some interesting facts about the recent Costa Mesa police DUI checkpoint.  Despite more than 1,000 persons passing through the checkpoint, the Costa Mesa Police Department only arrested one person at a DUI checkpoint Friday night on Bristol Street.

Police stopped 503 of the more than 1,000 vehicles that passed through the stop. Officers investigated 46 people for possible DUI but arrested none on suspicion of driving drunk, officials said.

Four vehicles were towed, 15 were impounded and 35 people were given tickets.

Funding for the checkpoint was provided by the California Office of Traffic Safety.

COSTA MESA – Police issued 35 citations, impounded 15 cars and made one arrest during a police sobriety checkpoint Friday on Bristol Street north of Bear Street.

There were no drunken driving arrests made. The checkpoints are conducted to remove impaired drivers off the road and bring awareness to the dangers of driving under the influence of drugs/alcohol and driving without a license.

The Glendale Police Department in cooperation with the Avoid the 100 regional DUI task force) will be conducting a DUI/Drivers License checkpoint on Friday, May 7, 2010, from 6:30 p.m. to 2:30 a.m. In an effort to reduce the number of persons killed and injured in alcohol involved crashes, DUI checkpoints are conducted to identify offenders and get them off the street, as well as educate the public on the dangers of impaired driving.

This DUI/Drivers License checkpoint is an effort to reduce those tragedies, as well as insuring drivers have a valid driver’s license. Another Los Angeles DUI checkpoint was announced, and here’s all the details.

When: Saturday, April 10, 2010 6:00 p.m. to 1:00 a.m.

Where: Western Avenue between 59th Street and Slauson Avenue In LAPD’s 77th Division

Who:LAPD’s Crime Task Force/Driving Under the Influence (DUI) Enforcement Detail South Traffic Division

Why: Despite the tireless efforts of thousands of advocates and law enforcement officers alike, drunk driving continues to be one of America’s deadliest crimes.  This operation will be conducted in an effort to reduce the incident of injuries, death, and property damage associated with the intoxicated driver in this area.  77th Division has experienced a 27 percent increase in DUI related traffic collisions, year to date as compared to 2009.

The checkpoint will serve as a reminder to the community of 77th Division to use designated drivers and not drink and drive.  Our message is simple: if we catch you driving drunk, you will be arrested.
