Arrests Planned for All Orange County DUI Drivers Now Through Labor Day
Our Orange County DUI lawyers have learned that between August 20 and September 6, several California counties will join an intense nationwide crackdown on drunk driving. The campaign is called “Drunk Driving. Over the Limit: Under Arrest.” Los Angeles County, Orange County, and San Diego County are among participating counties in California.
In Orange County, officers will conduct 5 checkpoints, 1 multi-agency DUI Task Force operation, 10 local roving DUI saturation patrols, a court sting operation, and a warrant/probation sweep targeting Orange County DUI repeat offenders. During the campaign, all impaired drivers will be arrested, according to officials involved in the campaign. Those arrested during the sweep are being threatened with jail time, loss of a driver’s license, fines, and possibly being ordered to use ignition interlocks.
According to officials involved with the program, fatalities and injuries due to alcohol in California have decreased significantly since the enforcement campaign began, from 1,780 in 2007 to 1,317 in 2009.

The Memorial Day Weekend “Avoid the 38” – DUI Campaign concluded this past weekend with the deployment in Orange County of two Sobriety Checkpoints along with DUI Saturation Patrols focusing special attention towards drivers. Our Newport Beach DUI Lawyers warned you about these DUI Checkpoint Locations in Orange County at the start of the Memorial Day holiday weekend.

I was contacted by the owner of a DUI blog in Tampa Florida, who runs the Fight your DUI blog, and thought I’d give a shout out to what seems to be a well written blog in the field of DUI Defense.
I always think it’s funny that, since my law firm is in Orange County California, and I advertise our services as Orange County DUI Lawyers, that I get a lot of Florida calls, as there’s an Orange County, Florida and sometimes the distinction is not made in a quick internet search. (Note also a bit of trivia: Both Disneyland USA parks are in Orange County, just in different states).
So, now I have a contact in at least one area in Florida – for anyone that needs a Tampa DUI Attorney.

Our Orange County DUI Lawyers have learned that the “Avoid the 12” DUI Task Force will be conducting DUI roving patrols in the cities of Aliso Viejo, Laguna Niguel, Laguna Hills and Laguna Woods on Friday, February 12, 2010. These Multi-City DUI teams will target areas that have a high incidence of DUI-related arrests and collisions.
The goal of the program is to spend funding from the federal government and MADD specifically for DUI checkpoints, even though DUI checkpoints are not an effective way to prevent DUIs.
Orange County Sheriff’s Department Deputies are committed to working hand in hand with their contract city partners in providing a safe environment for the motoring public.
Funding for this program is provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.

A DUI charge can trigger the following expenses, according to the Auto Club of Southern California:

Penalties (minimum) $780
Vehicle Tow and Storage: $187
Alcohol Education Class: $500
Auto Insurance Increase (3 years): $8,652 average

DMV License Re-issue fee: $125

Attorney and legal fees (average): $2,539
TOTAL (minimum) $13,500.00
Plus, and I can assure of this from 15 years of being a DUI Specialist in Orange County, it’s common for clients to go through all of the following:
Shame and humiliation;
Lost work time and wages
Medical costs (in some cases)
Vehicle Property Damage (in some cases)
Civil liability
Loss of a Driver’s License
Need for alternate transportation.
Take it from our Orange County DUI lawyers, drinking and driving is an expensive proposition. Make sure you know your defenses before you decide to pay the price.

Police agencies all over Orange County are inviting the media to come along for their DUI checkpoints, which, as someone among the few Orange County DUI Lawyers on the front lines of DUI defense in this county, I have repeatedly reminded people don’t work.
However, I was surprised to see an Orange County Register article mentioning in their photo caption that “DUI checkpoints in Orange County rarely result in many arrests, instead being used as deterrents.”
Funny that they would say that DUI checkpoints are deterrents, since most of the DUI checkpoint locations are not announced, a potential violation of the State of California Supreme Court’s Ingersoll case. If they were not trying to catch people, but merely deter them, shouldn’t they be getting the word out early, vocally, and often, to “deter”, instead of arrest?
The article is below, and I am assuming that it’s based upon the Costa Mesa Police Department after report, which was first published at the Costa Mesa PD website, here.
“COSTA MESA – Motorists on Tuesday night for the most part didn’t let the holiday season ruin their good judgment, as a DUI checkpoint netted just one suspected drunk driver out of nearly 300 cars.
Costa Mesa police from 6 p.m. to midnight staged the sobriety-screening operation on Santa Ana Avenue at 18th Street. During that time, 296 vehicles drove through, 142 were stopped for further screening and 11 motorists were screened for drunken driving, but in the end, there was one DUI arrest. …”

Another one of the Orange County DUI Checkpoint Locations for this holiday season has been revealed, this time in Aliso Viejo, on New Year’s Eve:
The Orange County Sheriff’s Department will be conducting a sobriety / driver license checkpoint on December 31, 2009, from 7:00 p.m. on December 31st to 3:00 a.m. on January 2nd, 2010 in Aliso Viejo. (This may be a misprint on the part of the OC Sheriff’s Department, as it’s unusual for a DUI checkpoint to operate continually for 32 hours. The checkpoint location was not announced.
Orange County DUI arrests were headed down this year, until the State approved an all out 300 checkpoint holiday sweep, to bring stats up, for law enforcement funding. Looks like this might be the only up year in a 10 year decline in all crimes, especially DUI.

Our Orange County DUI Lawyers do our best to bring you current relevant information about Orange County DUI Checkpoint Locations. Note this article, which originated as a press release from the Avoid the 28 campaign.
Note also the DUI checkpoint information at the bottom of this post, revealing Orange County DUI Checkpoint locations in Anaheim, Costa Mesa, and Aliso Viejo.
154 people were arrested on suspicion of driving under the influence in Orange County during a weeklong campaign in effect through Christmas Day, according to the multiagency DUI task force known as “Avoid the 28″.
From Dec. 18 through Dec. 25, avoid the 28 reported that 154 arrests were made in O.C. cities. There were no fatalities.
Sgt. J. Brittain with Orange County Sheriff’s Department Traffic Bureau said the number will be higher because not all agencies have reported their statistics.
Last year, law enforcement agencies reported 309 arrests from Dec. 12 through Dec. 25, with three fatalities.
The campaign, known as “Avoid” – involving the California Highway Patrol, the Orange County Sheriff’s Department and police departments – lasts through Jan. 3.
The California Highway Patrol made 53 DUI arrests on O.C. freeways during its maximum-enforcement period, which started at 6 p.m. Christmas Eve and went through midnight Sunday, said CHP officer Denise Quesada. No fatalities were reported.
Throughout the state, 16 people were killed on highways over the Christmas holiday weekend – the same number of fatalities for the same period last year.
The number of drunken-driving arrests made by the CHP is up, however – to 970 from 824 in 2008. The figures cover the time period from 6 p.m. Christmas Eve until 6 a.m. Sunday.
California’s Office of Traffic Safety has declared 2010 the “Year of the Checkpoint” and has planned to spend $8 million in checkpoint grants statewide. That effort began Dec. 18 with more than 250 checkpoints scheduled around the state between then and New Year’s weekend.
In Orange County, a dozen cities will receive a total of about $420,500 for checkpoints this month and throughout 2010. To get the money, they had to agree to staff at least one checkpoint a month, as well as a bigger push to fight drunken driving during the winter holidays and again around Labor Day weekend.
As previously reported, a Costa Mesa DUI Checkpoint will be run on December 29, 2009, in Costa Mesa. Also, on Dec. 31, DUI saturation patrols are scheduled from 8 p.m. through 3 a.m. in Anaheim. In Aliso Viejo, a DUI checkpoint is scheduled from 7 p.m. Dec. 31 to 3 a.m. Jan. 2.
